« Eliza H. W. Allsopp raised a reduction of a decree of divorce which had been obtained in absence against her by James Allsopp, Paymaster of the 17th regiment of Foot. After obtaining an award, under an incidental petition, for an interim sum of aliment and expenses', she stated that the defendent resided out of Scotland, and was bound to sist a mandatory.
The Lord Ordinary, on the 7th of July last, in respect of the fact was admited, "appointed the defendent produce a mandate that the person in this country who is willing to sist himself in this mandatory in this cause, and that by the first box-day".
Allsopp reclaimed ; but the court adhered.
